A student and her DJ boyfriend were last night ordered to stay in jail after they were arrested in a raid on the accused drug dealer who allegedly supplied Philip Seymour Hoffman with his fatal dose of heroin.

Juliana Luchkiw, the 22-year-old daughter of a lawyer, and boyfriend Max Rosenblum were arrested Tuesday night in their home during a drug raid on their next door neighbor, jazz musician Robert Vineberg.

Vineberg is accused of being the drug dealer who sold the heroin that PSH apparently overdosed on - and it appears that the young couple were caught up in the raid as well when police found cocaine in their apartment.

Luchkiw was charged with possessing cocaine and screamed, 'Why is this happening? I can't spend another night in here!' as she was denied bail.

Her DJ boyfriend Rosenblum, 22, was also charged with cocaine while Vineberg was charged with possessing heroin with intent to sell after hundreds of bags of heroin were found in his apartment.

Manhattan Criminal Court Judge Felicia Maddin ruled that she couldn't hear bail applications because the case was indicted and was now the jurisdiction of Manhattan Supreme Court.

Charges were dropped against a fourth person, Thomas Cushman 48, who was arrested at a third apartment during the raid. According to the New York Daily News he was the only one arrested who didn't live there.

'I was visiting,' he said. He reportedly was sporting a black eye he blamed on police. 'I had nothing to do with it.'

'She's not a drug dealer. She's a college student,' Stephen Turano, Juliana Luchkiw's lawyer, told the judge as he, along with attorneys for Rosenblum and Vineberg, vigorously denied his client had any role in Hoffman's death.

Vineberg's lawyer even suggested his client was being used as a 'scapegoat.'

'This case and the charges against Mr. Vineberg have absolutely nothing to do with the death of Philip Seymour Hoffman. ... We're hoping the (district attorney) will not use Mr. Vineberg as a scapegoat,' said his lawyer, Edward Kratt, who declined to say whether Vineberg knew Hoffman.

According to the New York Daily News, three cell phones containing Hoffman's number were found during the raid. At least one of the cells belonged to Vineberg, police said.

However, prosecutors Wednesday stopped short of linking him to the heroin that killed Hoffman.

'There's a very active ongoing investigation into who sold it,' a source told the Daily News.

The arrests came two days into the high-profile case, reflecting the attention and urgency it has attracted.

All three of the people charged were indicted within a day after their arrests, a fairly unusual step, and were being held without bail. The two charged with cocaine possession, Juliana Luchkiw and Max Rosenblum, a couple who are neighbors of Vineberg's, were visibly dismayed when they were denied bail, though their lawyers hoped to revisit the issue Thursday.

Rosenblum's lawyer, Daniel Hochheiser, said his client 'has nothing to do with Philip Seymour Hoffman.'

Luchkiw and Rosenbaum had two bags of cocaine, while investigators found about 300 packets of heroin, a bag of cocaine and about $1,200 in cash in Vineberg's apartment, according to criminal complaints.

Four people were arrested in the late night raid after a tipster, responding to publicity about Hoffman's death, told police he had seen the actor at Vineberg's apartment building.

But prosecutors declined to pursue charges against one of the four, saying there was no evidence that he had control of the heroin found or the apartment in which they were discovered.

Rosenblum and drama student Luchkiw, both 22, are Vineberg's neighbors. They were arrested in their own apartment and charged with misdemeanor drug possession and criminal use of drug paraphernalia.

Thomas Cushman, the fourth suspect who was released, was also arrested on drug charges in a third apartment during the police swoop around 7.30pm.

Luchkiw, a student at The New School, was pictured by the Post walking into a Manhattan police station on Tuesday alongside Rosenblum who she has been reportedly dating for a year. She yelled: 'Stop taking pictures, stop taking pictures.'

Rosenblum tried to calm down his girlfriend by telling her: 'This has nothing to do with you, babe.'

Luchkiw's family are from Harrington Park, New Jersey and her father Michael is a partner at law firm Decotiis FitzPatrick Cole & Wisler based in Teaneck.

When MailOnline called her family home a woman who identified herself as Luchkiw’s mother said: 'You're making me very nervous right now, I can't talk to you' and hung up.

'I just know she was a great kid,' a neighbor, who wished to remain anonymous, told MailOnline after being informed of the heroin rap slapped against Luchkiw.

A childhood friend, who also requested anonymity, told MailOnline: 'I can tell you right now she's not a drug dealing kingpin.'

Rosenblum appears to have had a similarly privileged upbringing. His brother Josh is a lawyer while his sister attended Columbia University in New York.

The aspiring DJ constantly plugs his own tracks on social media and appears a fixture of the New York rave scene.

On February 2, the day that Hoffman was found dead from an apparent drug overdose, Rosenblum retweeted a message to his Twitter profile which read: 'Dealer turnt dj.'

Investigators have determined that the 'Capote' star made six ATM transactions for a total of $1,200 inside a supermarket near his home the day before his death, law enforcement officials have said.

Investigators are examining a computer and two iPads found at the scene for clues and recovered syringes, a charred spoon and various prescription medications, including a blood pressure drug and a muscle relaxant, law enforcement officials have said.

Police learned from phone records that one of the suspects had Hoffman's cell phone number, strengthening the theory that they may have supplied him with drugs, the law enforcement officials said.

The officials, who weren't authorized to speak about evidence in the ongoing investigation of the death and spoke to The Associated Press on the condition of anonymity, didn't identify which of the suspects had the number.

The young couple have been dating for around a year according to reports. They were arrested last night during a drug swoop by the NYPD

Some of the packets found in Hoffman's apartment were variously stamped with the ace of hearts and others with the ace of spades. Those found in the building where the arrests occurred had different brand names, including Black List and Panda, the officials said.

Police were waiting for a cause of death for the Oscar-winning actor from the medical examiner's office, which said on Wednesday that more tests were needed.

There was no timetable for Hoffman's autopsy to be finished, said medical examiner's office spokeswoman Julie Bolcer, who declined to discuss the pending tests. Toxicology and tissue tests are typically done in such cases.

Hoffman, 46, was found dead Sunday with a needle in his arm, and tests found heroin in samples from at least 50 packets in his apartment in Manhattan's Greenwich Village, law enforcement officials have said.

Courts have found that under state law drug dealers can't be held liable for customers' deaths.

A 1972 state appellate division case found a dealer can't be found guilty of manslaughter or criminally negligent homicide for selling heroin and syringes to a customer who later dies because, the court ruled, legislation enhancing punishment for drug crimes didn't redefine homicide to include the sale of an illicit drug that results in death.

And holding a drug dealer criminally liable for a customer's overdose death could prove difficult for the district attorney's office, said James Cohen, a Fordham University School of Law professor who runs a clinic that represents federal criminal defendants.

'It's not just enough that you know, if you will, theoretically or academically, that heroin could kill,' he said.

Hoffman's number was found in a phone belonging to drug dealer Robert Vineberg after the police raid in Manhattan's Nolita that was based on a tip-off that he may have sold heroin to the late actor.

Vineberg's stepdaughter Christina Soto, 33, confirmed on Tuesday that he did push drugs and knew Hoffman but insisted that her stepfather did not sell Hoffman the heroin batch which is believed to have killed him. Vineberg had not seen Hoffman since November, his stepdaughter claimed.

Earlier this week it was reported that Hoffman, who had been clean for 23 years until last May, tried to persuade her ex, Heath Ledger, to quit drugs.

Ledger, the father of Willams' 8-year-old daughter, Matilda, died of a prescription drug overdose in his New York apartment in 2008, aged just 28, but he reportedly also battled with heroin and cocaine addiction.

Joaquin Phoenix visited O'Donnell again Wednesday, this time with his girlfriend, Allie Teilz. Phoenix, who starred alongside the beloved actor in the critically acclaimed The Master, spent hours at O'Donnell's home, presumably also comforting Hoffman's three children, Tuesday night.

Three men, including Vineberg, and one woman suspected of supplying Hoffman with the heroin that ended his life were arrested. The suspected dealers were nabbed with 350 bags of the drug, after the heroin believed to have killed the Oscar-winning actor was traced to the apartment.

The arrests came as it was revealed the heroin found near the Hoffman's body Sunday didn't contain the powerful additive fentanyl, which has been linked to 22 suspected overdose deaths in western Pennsylvania. However, it could have been tainted with another deadly ingredient.

Bobby Cannavale and legendary photographer Annie Leibovitz were also among the friends and well-wishers who have come by the Jane Street apartment to offer their condolences to the distraught mother-of-three. All of the A-listers looked somber.

According to sources, a private wake for Hoffman's family and friends will be held at the Frank E. Campbell Funeral home from 5pm to 9pm on Thursday.

The only time O'Donnell has been spotted since her longtime partner's death was when she visited an Upper East Side funeral home Tuesday to start planning Hoffman's funeral, scheduled for Friday at St. Ignatius of Loyola.

Also Tuesday, Hoffman's grieving mother, Marilyn O'Connor, arrived in Manhattan to be with her grandchildren.

Hoffman and O'Connor were extremely close and her even dedicated the 2005 Academy Award he won for 'Capote' to her. She was seen again outside the family home Wednesday.
